Big Pharma's shame: emerging markets bribery

According to a signal from the electronic tag around his ankle, Nenad Borojevic last left his apartment building at 6.25 p.m. on January 10. It was the festive season in Serbia; the capital was enjoying the lull between Orthodox Christmas and New Year.

Police said Borojevic, a doctor, headed to Kosutnjak park, a popular wooded area in Belgrade dotted with restaurants and criss-crossed by jogging paths.

Borojevic had been one of Serbia's most eminent doctors, a director of the Institute for Oncology and Radiology. Now he was due in court in five days to face charges brought by the public prosecutor that he had taken bribes from international drug companies as incentives to use their products. The electronic tag was a condition of his 500,000 euro ($660,000) bail.

The next day, around noon, a passer-by found Borojevic hanging from a tree on a nylon rope five millimeters thick. Police found a suicide note in the mailbox of his wife, from whom he was separated. It had been sent from a local post office. "I couldn't take it anymore," it said.

Borojevic's story, some of which emerges here for the first time, is a particularly gruesome example of what even people in the global drugs business concede is a growing problem: bribery and corruption in emerging markets. The 51-year-old cancer specialist was one of a group of 10 Serbia-based doctors and drug company officials charged in 2010 with taking, or offering, more than 500,000 euros in bribes to persuade the medics to use specific products. The doctors are alleged to have personally gained from the choice of medicines used; the drug company representatives with illegally offering the incentives.

In recent years, Big Pharma has forked out billions of dollars to settle scandals involving improper promotion of medicines in the United States. Now bribes paid to foreign doctors and other state employees are shaping up as the next major legal liability threat for the industry. A Reuters examination of U.S. Securities and Exchange Commission (SEC) filings by the world's top 10 drug companies has found that eight of them recently warned of potential costs related to charges of corruption in overseas markets.

One factor driving the trend is a search for new business. Companies whose profit margins have been squeezed in the developed world are increasingly turning to thinly regulated emerging markets for growth. At the same time, U.S. and European governments are toughening up on bribes paid by companies overseas. The U.S. Foreign Corrupt Practices Act and Britain's new Bribery Act, which came into force last July, are both targeting drugs companies for special scrutiny, providing new impetus for the industry to clean up its act.

"There's clearly a legal risk from violating laws with the current drive into emerging markets, so mis-selling cases in these markets could become a significant legal threat for the industry," said Chris Stirling, European sector leader for pharmaceuticals at KPMG in London. "The business practices in these countries are very different from the sort you find in Western Europe and the United States."

Borojevic's suicide - police have ruled out foul play - means certain aspects of his case, which is being investigated at a national level, may never be known. The trial of the other men and women in the group is continuing. All the defendants have pleaded not guilty, though one of the six drug company representatives involved agreed a plea bargain and another turned witness for the prosecution.

Operation Crab
The probe of Borojevic, which police called Operation Crab, started with a tip-off in March 2007, according to a police source involved in the investigation.

At a later point, police received information from a former mistress of one of the accused, the investigator said, declining to name her. "After they broke up, she came to us and recited everything - names, places, contacts, how they operated, how much everyone received and from whom, when and where," said the investigator. "She even gave us some concrete evidence which helped us a great deal."

Some of Serbia's tabloid media said the informant was a former Serbian model, Katarina Rebraca, who herself, in a separate case, had in April 2010 faced charges of embezzling funds at a breast cancer charity she ran. Borojevic, the doctor, had been called as a witness for the prosecution against her, although he died before testifying.

Rebraca declined to comment. Her lawyer, Dragan Mrakovic, said: "It is not in the best interest of my client to give any information whatsoever" about the Borojevic case. "This has nothing to do with my client's case, nor does my client have anything to do with the pharmaceutical corruption case."

The informant led police to a rented apartment in Medakovic, a neighborhood of communist-era apartment blocks and family homes in Belgrade. Here a group of doctors and drugs company sales representatives would allegedly meet and hold "raunchy, loud parties with Belgrade babes, three or four times a week," said the police investigator. It was not possible to confirm who had rented the apartment.

In June 2010 police arrested Borojevic: the charges against him and four colleagues included running a criminal conspiracy in cancer drugs from 2007 to 2009. The indictment said that the alleged scheme, whereby drug company representatives gave inducements to the doctors to use their companies' products, had increased sales of a number of generic chemotherapy medicines as well as branded cancer medicines including Roche Holding AG's Avastin and Erbitux, made by Merck KGaA of Germany.

For Borojevic, the alleged gains were significant, especially in a country whose GDP per capita the IMF puts at just $6,500 a year. In total, he was accused of receiving a total of 11.2 million dinars ($138,000) in kickbacks from drug companies.

Officials at drugs companies AstraZeneca Plc, Sanofi SA and Actavis confirmed they were served in July and August 2011 with criminal indictments related to allegedly improper payments to physicians including Borojevic at his state-run institute, and said they had filed certain procedural objections. Icelandic pharmaceutical company Actavis gave the most expansive statement: "The allegations include bribery of state officials in order to obtain preferential status when it comes to the sale of oncology products in Serbia," said the company, which moved its headquarters to Zug, Switzerland in 2011.

All declined further comment on the proceedings. Also charged with alleged bribery in the case were representatives of Roche, Merck KGaA and PharmaSwiss - a unit of Canada's Valeant Pharmaceuticals International Inc - all of whom declined to comment.

Reps take the rap
In one instance, the police allege, Borojevic and his colleague Zoran Bekic, head of the Institute for Oncology and Radiology's pediatric oncology ward, received 95,000 euros from Goran Orlic, a representative for Actavis. Orlic allegedly paid the men for inside information about its business plans.

The Actavis representative received immunity from prosecution in exchange for his testimony ahead of the trial, the court said in a statement. Actavis said Orlic left the company in 2009. Neither Bekic, the pediatrician, or his lawyer would comment. Orlic could not be reached.

Another of those charged was Merck KGaA's representative, Jasmina Gutovic. She reached a plea bargain with prosecutors and admitted giving bribes, according to the judge who heard her case. While Gutovic was convicted, the court will not say what punishment she received while the rest of the case is being heard. Merck KGaA confirmed she left the company in June 2011 and she could not be reached for comment.

The indictment against Borojevic also states that he and colleagues did a deal with unnamed drug company sales staff to develop "new therapeutic applications" using their companies' drugs, as a way of further boosting sales of the products. In the months before his death, Borojevic was portrayed in Serbian media as a poisoner of children, based on suggestions in the media that he had overprescribed.

Borojevic was released on bail in November 2011. He repeatedly denied all the charges against him, saying he was the victim of a media witch hunt. "Nothing is true from the indictment," he said in a statement in May 2011.

His lawyer, Strahinja Kastratovic, said that the day before Borojevic killed himself, he had learned the apartment he had bought with his estranged wife would be seized by the court. "He said, 'I can't take this anymore, I don't know how to fight this or against whom I'm supposed to be fighting,'" said Kastratovic. He declined to elaborate.

Temptations increase
Corruption is rife in Serbia, which is ranked 86th out of 183 countries in Berlin-based Transparency International's corruption perceptions index. The drugs business is particularly exposed to corruption, Transparency International says: pharmaceuticals create vast opportunities for graft across both rich and poor countries. Its 2011 Bribe Payers' Index ranks pharmaceuticals and healthcare 13th out of 19 industries on probity - a lower ranking than defense firms, though above mining and construction.

"There are a number of classic red flags for bribery that indicate the pharma sector is particularly vulnerable," says Robert Barrington, TI's director of external affairs. These include a tradition of gifts and hospitality, a lack of transparency over pricing and the need for regulatory approval in everything.

In many parts of the world lavish gifts such as all-expenses-paid trips to resorts and golf days remain common, even though the industry has reined in such hospitality in the United States.

Temptations may increase as companies move into the developing world. IMS Health, which analyses pharmaceutical industry trends, says 17 key emerging markets will account for around 63 percent of worldwide growth in prescription drug sales between 2010 and 2015.

"It is almost guaranteed that every multinational pharmaceutical company is going to end up with these issues and is going to have to go through a painful experience," says one in-house lawyer at a major U.S. drugmaker. "Frankly, the odds are stacked against companies."

'Not ethical, but universal'
The Serbian charges and claims of corruption extend beyond Borojevic and his colleagues. In his defense, Borojevic always insisted that he could not approve drug purchases alone, but passed on recommendations to the state-run Department of Health Insurance. That itself is the target of other, unrelated corruption charges brought by the public prosecutor against its former head, Svetlana Vukajlovic, who has been in pre-trial detention since September 2011.

An example from another Balkan country, Greece, underlines how ingrained such practices can be. Earlier this month, London-based Smith & Nephew Plc, Europe's biggest maker of artificial knees and hips, agreed to pay $22 million to settle SEC allegations that it bribed doctors in Greece to use its products. Among documents the SEC released as part of the dossier was a note jotted down in 1999 by an unnamed in-house lawyer for the company.

"Pay surgeon to use prod(uct)," it read. "Not legal or ethic; but universal."

In that case, the company's Greek distributor sent an email to the firm's U.S.-based head of international sales seeking to maintain access to one of the slush funds used to pay doctors to buy S&N products: "I absolutely need this fund to promote my sales with surgeons, at a time when competition offers substantially higher rates," he wrote. The fund's "only reason for being is the need for cash incentives, a real pain in the neck but an unavoidable fact of Greek life."

S&N CEO Olivier Bohuon, who took office in 2011, long after the alleged bribery occurred, said the company had moved on but the episode showed the need to remain vigilant.

Over the past year eight of the world's top 10 drugmakers - Pfizer Inc, Novartis AG, Merck & Co Inc, Sanofi, AstraZeneca, GlaxoSmithKline Plc, Johnson & Johnson and Eli Lilly & Co - have all warned that they may face liabilities related to charges of corruption in numerous overseas markets.

Investigations into potential wrongdoing by pharmaceutical firms cover activities in countries including Argentina, Brazil, Canada, China, Germany, Italy, Poland, Russia and Saudi Arabia, according to company filings. They also involve possible improper conduct of clinical trials, which are increasingly being run in lower-cost Asian or East European countries.

'Just say no'
One reason such cases are surfacing now is the renewed vigor with which U.S. officials have enforced its foreign corruption law since November 2009. That's when U.S. assistant attorney-general Lanny Breuer told a pharmaceutical conference: "We will be intensely focused on rooting out foreign bribery in your industry."

The 1977 Foreign Corrupt Practices Act makes it illegal for U.S. companies and foreign firms whose stock is traded in the United States to bribe government officials in foreign countries. Officials at the U.S. SEC and Department of Justice (DOJ) declined to say if they planned to follow the Serbian probe with their own investigations.

Some drug firms have already started to come clean. In the first case of its kind, Johnson & Johnson settled for $78 million with U.S. and British authorities in April last year, after disclosing voluntarily to U.S. authorities back in 2007 that it had made payments to doctors in Poland, Romania and Greece who chose to use J&J medicines and surgical implants.

Pfizer, which in 2004 became the first pharmaceutical company to volunteer information about past wrongdoings to the DOJ and the SEC, is likely to be the next big firm to settle. The world's biggest drugmaker, it reached an agreement in principle with U.S. authorities towards the end of last year and is set to finalize a deal during the first half of 2012, according to people familiar with the discussions.

Under U.S. and British law, the onus is on a corporation to report improper behavior by either its own staff or outside contractors. In some cases, this has already meant radical change. AstraZeneca, for example, said last May it was ending all payments to doctors attending international scientific and medical congresses.

"I know that this is not easy," Chief Executive David Brennan told a conference at the time. "I know from my own experience as a sales representative, you will encounter people who will ask for gifts, or other inducements. And they will threaten to take their business elsewhere, if you don't acquiesce. But we have made it clear that our sales force have to say no."

Braun was confident he'd win, questions baseball's drug-testing procedures

Less than 24 hours after Braun's suspension was overturned by an arbitrator, a decision that irritated Major League Baseball officials, the star outfielder was back with the Brewers.

With many of his teammates, in full uniform, sitting in the stands of Maryvale Baseball Park, Braun confidently professed his innocence while questioning the system that allowed him to be suspended for failing a test he took after a playoff game Oct. 1.

He is the first major league player to successfully challenge a drug-related penalty in a grievance, ending a four-month personal "nightmare."

"There were a lot of times where I wanted to come out and tell the entire story, attack everybody as I've been attacked as my name has been dragged through the mud as everything in my entire life has been called into question. I wanted to come out and tell the entire story, but at the end of the day I recognize what is best for the game of baseball," Braun said.

"I can't ever get that time in my life back."

Smartly dressed in a blue pullover and jeans, Braun, 28, walked slowly down the right-field line to a podium set up near home plate to address the lifting of his suspension. With about 30 reporters on hand and the sun beating down, Braun spent 13 minutes recapping an episode he called "the biggest challenge I have faced in my life."

Braun rarely looked at his notes while laying out a detailed time line of events that led to his suspension. He was poised and prepared as he took the first steps in trying to repair his reputation.

Soon after thanking teammates and fans, Braun expressed disappointment that the confidentiality of his urine test was broken and information leaked. ESPN first reported his failed test for a high testosterone level in October. Braun, who batted .332 with 33 homers and 111 RBIs last year while leading the Brewers to the Central Division title, called some reports he did not single out "inaccurate, erroneous and completely fabricated."

Braun learned on Oct. 19 that his sample tested "three times" the level of any previous specimen, a fact that startled and confused him. He said he began "a humanistic" defense by showing documentation he never gained a pound, his running times did not improve and he didn't get any stronger.

"I truly believe in my heart and I would bet my life that this substance never entered my body at any point," he said.

Braun cited a possible "chain of custody" problem with his sample. He said the urine test he provided Oct. 1, when the Brewers opened the playoffs, was not delivered to Federal Express until Oct. 3. Baseball's drug agreement calls for samples to be delivered to FedEx on the same day they are collected.

Braun did not rule out the chance that someone may have tampered with his sample.

"I honestly don't know what happened to it for that 44-hour period," he said. "There are a lot of different things that could have possibly happened. There are a lot of things that we heard about the collection process, the collector and some other people involved in the process that have been concerning to us. But as I've dealt with the situation, I know what it's like to be wrongly accused of something, so for me to wrongly accuse somebody wouldn't help."

Braun said he was a "victim" of a "fatally flawed" testing system and that there is an inherent presumed guilt within the process.

"As players, we're held to a standard of 100 percent perfection regarding the program, and everybody else associated with that program should be held to the same standard," he said. "We're a part of a process where you're 100 percent guilty until proven innocent. It's the opposite of the American judicial system.

"This is my livelihood. This is my integrity. This is my character. This is everything I have ever worked for in my life being called into question. We need to make sure we get it right. If you're going to be in a position where you're 100 percent guilty until innocent, you can't mess up."

Soon after Braun's news conference, MLB and the players association each released statements defending the testing program. And the head of the World Anti-Doping Agency, David Howman, said that under his agency's rules, Braun still would have had to show that the departure from the rules was related to the test result.

"Our program is not 'fatally flawed,' " MLB executive vice president Rob Manfred said. "Changes will be made promptly to clarify the instructions provided to collectors regarding when samples should be delivered to FedEx based on the arbitrator's decision. Neither Mr. Braun nor the MLBPA contended in the grievance that his sample had been tampered with or produced any evidence of tampering."

Arbitrator Shyam Das threw out Braun's ban Thursday. Das, who has been baseball's independent arbitrator since 2000, informed the sides of his decision, but did not give them a written opinion. He has 30 days to do so.

Moments before Braun publicly addressed his situation, manager Ron Roenicke, general manager Doug Melvin and 16 players took seats behind the first-base dugout to show their support.

Popular Drink Recipes: The Coconut Mojito

Friday could not have come a moment too soon for me this week, and I am so glad that it?s finally here.? I started the week on my back in a drug induced haze.? Lest you think that was recreational, or that I have tipped over the edge and am on my way to rehab?it was neither.? Last week I sliced my finger open on my mandoline and had to get my finger glued back together.? It sucked and it hurt.? I?ll get to that in a later post.? So to say that I am happily off pain killers and looking forward to celebrating the weekend with this coconut mojito in hand, would be a bit of an understatement.

As far as drink recipes go, this has to be one of the healthier one?s I?ve done.? Sure, I?ve made a margarita recipe loaded with good for you Vitamin C (from all that fresh citrus fruit) and a martini recipe that included the healthy fats from peanut butter and heart healthy chocolate all in one glass.? But this mojito recipe tops them all.

While I?m not going to say that this is some magical health elixir, it does contain alcohol after all, but it?s other ingredients are in their unadulterated (look at me using big fancy words?just trying to amortize those college degrees whenever I can) states and are pretty darn good for you.

Some of the popular drink recipes, for a coconut mojito, use calorie and fat laden coconut cream.? This recipe uses coconut water that is much lighter in flavor, and calories, but also contains lots of potassium and electrolytes.? The matcha powder in this recipe is packed with antioxidants.? In contrast to those alcohol and caffeine packed drinks, this one is alcohol and healthy ingredient packed.? That doesn?t mean you should get all stupid and drink a bunch of these mojitos and think the healthy ingredients are balancing out the alcohol.? That?s using the same rationale as ?Hey honey, it doesn?t matter that I just spent $1000, I saved us money because it was all on sale.?

Yes, I realize that this is not your typical mojito recipe, but you know what?? Typical is overrated.? Besides, you?ve got the basic mojito flavors in the drink.? That?s how you create new cocktail recipes.? Start with the basics and expand on them.? Even the most serious of cocktail aficionados have fun behind the bar and mix up new and exciting cocktails.? How do you think popular drink recipes come to be?? So have fun with your mixing.

Ingredients

  • 1 1/4 Ounce Spiced Rum
  • 1 Teaspoon Turbinado Sugar (aka raw sugar)
  • 1/4 Teaspoon Matcha Powder (actually just a little less than 1/4 teaspoon is perfect)
  • 1/3 Ounce Lime Juice
  • 8 Good Sized Mint Leaves (6 torn and 2 chiffonade)
  • Coconut Water

Instructions

  1. Add the chiffonade mint leaves to the glass.
  2. In a shaker combine the all the ingredients, except for the chiffonade mint and coconut water.
  3. Muddle the ingredients with a muddler or the back of a wooden spoon.
  4. Add ice to the shaker. Cover and shake until your hand is so cold it feels like it?s going to fall off.
  5. Fill glass with crushed ice.
  6. Strain mixture into glass.
  7. Top with coconut water.
  8. Garnish with a mint sprig and lime wheel.
  9. Serve

Quick notes

To better mix mint pieces into drink, gently stir around with a thin knife.

To chiffonade cut the mint: stack the leaves, roll them lengthwise, then make thin (perpendicular) slices.? You?ll end up with ribbons of mint.

Variations

I served this in a stemmed cocktail glass, but you could also serve this in a rocks glass. The rocks glass will also let you use more coconut water (since the glass is larger).

World News - Russians rally for Vladimir Putin -- and 2 days off work

Thousands of people attended a march backing Vladimir Putin in Moscow, Russia, on Thursday. Russians will go to the polls on March 4.

MOSCOW -- Thousands of people marched in Moscow under Russian flags, balloons and banners on Thursday to back Vladimir Putin's bid to return to the presidency and counter opposition protests that have challenged his authority.

Putin?is running for a third term as president in an election on March 4. The 59-year-old is seen as certain to win, but is facing a strong challenge to his authority from a protest movement that has drawn large crowds to its rallies in Moscow.


The Associated Press reported that most of?Thursday's participants appeared to be workers paid by or dependent on the state, including teachers, municipal workers and employees of state companies.

Some people at the rally?told reporters?they were promised two days off in return for attending. Many?were reluctant to explain why they came, The AP reported.

"I came here with friends. They said they would pay each of us 2,000 roubles ($67)," said a 21-year-old man who gave his name only as Alexander. He and his friends were brought into Moscow by bus from just outside the city.

Putin's campaign team, which portrays him as a strong leader and guarantor of stability, has failed to quell reports that many of the people at pro-Putin rallies are paid or coerced into attending by employers and trade unions.

Wearing warm hats, scarves and coats on a chilly national holiday, the participants started marching along the banks of the Moscow River behind a long blue banner declaring: "Our vote for Putin."

The atmosphere was festive on Defender of the Fatherland Day, a holiday which honors the armed forces.

The AFP news service estimated that 30,000 people were attending the rally. However, the BBC cited Moscow police as putting the total at 130,000.

Police were out in force because the opposition communists and nationalists planned rallies in other parts of the capital.

The communists and nationalists also staged small rallies in several other cities across the vast country of more than 140 million people. There were no immediate reports of clashes.

If?Putin, a?former KGB officer, wins the election, he will extend his 12-year rule for another six years. Putin was president from 2000 until 2008, when he was barred by the constitution from running for a third successive term, but has remained dominant as prime minister.

The latest opinion poll this week showed he would win more than 50 percent of the votes on March 4, enough to avoid a second-round runoff. His rivals include nationalist Vladimir Zhirinovsky, communist Gennady Zyuganov and businessman Mikhail Prokhorov, who owns the New Jersey Nets.

Putin says many?people want him to return to the presidency; when he last held the office, Russians enjoyed an economic boom on the back of a surge in the price of oil, Russia's main export commodity.

After initially insulting the protesters who have taken part in opposition rallies sparked by allegations of fraud in a parliamentary election won by his party on Dec. 4,?Putin has allowed their main rallies to go ahead.

But he has accused foreign governments of backing the opposition protesters and has met none of their main demands, including a rerun of December's election, the release of people the opposition call political prisoners and far-reaching political reforms.

The next opposition protest in Moscow is planned for Sunday.

If?Putin wins two more terms, he could stay in power until 2024. The opposition protesters say a growing number of Russians feel they have no say in the way Russia is run and that it is bad for any country to be led by one person for so long.

Stronger intestinal barrier may prevent cancer in the rest of the body, new study suggests

ScienceDaily (Feb. 21, 2012) ? A leaky gut may be the root of some cancers forming in the rest of the body, a new study published online Feb. 21 in PLoS ONE by Thomas Jefferson University researchers suggests.

It appears that the hormone receptor guanylyl cyclase C (GC-C) -- a previously identified tumor suppressor that exists in the intestinal tract -- plays a key role in strengthening the body's intestinal barrier, which helps separate the gut world from the rest of the body, and possibly keeps cancer at bay. Without the receptor, that barrier weakens.

A team led by Scott Waldman, M.D., Ph.D., chair of the Department of Pharmacology and Experimental Therapeutics at Jefferson and director of the Gastrointestinal Cancer Program at Jefferson's Kimmel Cancer Center, discovered in a pre-clinical study that silencing GC-C in mice compromised the integrity of the intestinal barrier. It allowed inflammation to occur and cancer-causing agents to seep out into the body, damaging DNA and forming cancer outside the intestine, including in the liver, lung and lymph nodes.

Conversely, stimulating GC-C in intestines in mice strengthened the intestinal barrier opposing these pathological changes.

A weakened intestinal barrier has been linked to many diseases, like inflammatory bowel disease, asthma and food allergies, but this study provides fresh evidence that GC-C plays a role in the integrity of the intestine. Strengthening it, the team says, could potentially protect people against inflammation and cancer in the rest of the body.

"If the intestinal barrier breaks down, it becomes a portal for stuff in the outside world to leak into the inside world," said Dr. Waldman. "When these worlds collide, it can cause many diseases, like inflammation and cancer."

The role of GC-C outside the gut has remained largely elusive. Dr. Waldman and his team have previously shown its role as a tumor suppressor and biomarker that reveals occult metastases in lymph nodes. They've used to it better predict cancer risk, and have even shown a possible correlation with obesity.

Reporting in the Journal of Clinical Investigation, Dr. Waldman colleagues found that silencing GC-C affected appetite in mice, disrupting satiation and inducing obesity. Conversely, mice who expressed the hormone receptor knew when to call it quits at mealtime.

However, its role in intestinal barrier integrity, inflammation, and cancer outside the intestine is new territory in the field.

A new drug containing GC-C is now on the verge of hitting the market, but its intended prescribed purpose is to treat constipation.

This study helps lays the groundwork, Dr. Waldman said, for future pre-clinical and clinical studies investigating GC-C's abilities beyond those treatments in humans, including prevention and treatment of inflammatory bowel disease and cancer.

"We've shown that when you pull away GC-C in animals, you disrupt the intestinal barrier, putting them at risk for getting inflammatory bowel disease and cancer. And when you treat them with hormones that activate GC-C it helps strengthen the integrity of the intestinal barrier," Dr. Waldman said. "Now, if you want to prevent inflammation or cancer in humans, then we need to start thinking about feeding people hormones that activate GC-C to tighten up the barrier."

The Epson EX7210 Multimedia Projector ($649 direct) is a portable, easy to set up and use business projector with a good feature set and range of ports. Its data image quality isn?t perfect, but should be fine for typical business presentations made to small groups.

The EX7210?s light source, based on the 3LCD technology developed by Epson, is rated at 2,800 lumens. The projector provides WXGA (1,280 by 800 pixel) native resolution, at a 16:10 aspect ratio. It has a similar feature set to the Editors? Choice NEC NP-M260W ($850 street, 4 stars), a WXGA projector rated at 2,600 lumens. In addition to the zoom and focus wheels, the EX7210 also has a slider behind the lens to manually provide horizontal keystone correction.

The black EX7210 measures 3.1 by 11.6 by 9.0 inches (HWD), including feet, and weighs 5.1 pounds. It?s easily transportable in its included soft carrying case.

The EX7210?s ports include VGA-in; HDMI-in; 3 RCA plugs for composite video and audio; S-video; a type B USB port for connecting with a PC (USB Plug ?n Play provides easy connectivity with both Macs and Windows PCs); and a type A port that fits a USB thumb drive.

Still and Video Image Testing

From a distance of about 9 feet away, the EX7210 filled our test screen with an image about 65 inches on a diagonal. The image was bright in a darkened room, and held its own even with a considerable amount of ambient light. The projector should be fine for smallish conference rooms.

In my testing using the DisplayMate suite, the EX7210?s data image quality was adequate for business presentations in which exacting color isn?t required. Tinting was an issue; in many projectors, grays can look slightly greenish; in some test images with this model, the green tint was unusually pronounced. In our text testing, white-on-black text appeared slightly fuzzy, though readable, at the two smallest sizes, with traces of red and green tinted at the two smallest sizes, while the smallest size of black-on-white text was a bit fuzzy and showed a hint of red.

The EX7210?s video quality is good enough for showing short or mid-length clips, though I?d draw the line at movies. There was some loss of detail in bright areas in our test clips, and traces of posterization?abrupt changes in color where they should be gradual. In some action scenes, and scenes where the camera was quickly panning, I saw motion artifacts in the form of a very mild hatching, though I doubt that many viewers likely to be distracted by it.

Other Issues

The projector?s single 2-watt built-in speaker provides decent sound quality and volume, loud enough to be heard in a smaller conference room.

The Epson EX7210 Multimedia Projector is a capable WXGA projector, with a good range of connectivity ports (including HDMI-in and a port for a USB thumb drive that lets you present computer-free) and some nice features like USB Plug ?n Play and a slider for horizontal keystone correction.? Though data image quality is okay for most business presentations, the projector would not be ideal for situations in which exacting color and/or tack-sharp small text is needed.

The slightly heavier (though still portable) NEC NP-M260W ($850 street, 4 stars) and the featherweight Epson PowerLite 1775W, both Editors? Choice projectors, offer better data image quality, while the MP-M260W is bristling with connectivity choices. But you pay more for those models, and the EX7210 has some likeable features of its own.

Yes, and even for the past, he replied,

that it will turn out to have been all right for what it was,

The future, yes, and even for the past,

that it will become something we can bear.

The Courage to Witness: Easing the time of dying for those we love

Opening Reading: Witnessing is an archetypal and deeply human behavior, recognized to be of supreme value since the earliest experiences of our human ancestors.

The moment of the birth of a child is the moment when we get to witness the birth of Psyche into the body. Right then, Psyche herself sings her song of absolute joy at being born on earth. All who she touches laugh and play at the sight and sound of a newborns laughter. The young one explores and finds joy in so many things. But then after a year or two or three, as the child grows, the demands of society creep in and begin to box in the Psyche of the little one. School, social norms, and eventually work and family?the various demands of daily living? call upon each of us to pay attention. Eventually, as we move closer to the end of our life span?as one truly approaches the time of dying, many of the demands of daily living again fall away and much like at the start of life, Psyche again becomes free of many of the concerns of daily living?is the rent due? is there food in the frig? These things no longer matter?and it is at this time that we are able to bear witness to something absolutely exquisite?Psyche?s final farewell?her long lament of love that she sings as she prepares to separate from the body that she has shared for a lifetime. It is here, at this threshold, that we are able to touch the transcendent, the realm of the sacred, the realm of the divine, the place of the angels.

Sermon

The time of dying has always been filled with mystery and unanswerable questions. In 2009, Dr. Ajay Bhatnagar, an oncologist at the University of Pittsburgh Cancer Institute, reported that Ninety-five percent of patients wanted their doctor to be honest about their chances of a cure and how long they could expect to live.

How long do I have to live?

The question itself is pregnant with the fear of death and yet, paradoxically, the very same question holds within it an element of hope. And what about the element of time, often a hidden aspect of our lives.

From this very first question asked by a patient, the experience of time is brought into the discussion. Time has long been mythologized since the beginning of the human experience?Cronos, the source of Chronometer, circular face of a watch, Father Time?Aion, the Phoenician god of time and eternity.

At the end of life, there are two distinctly different sorts of times being lived. Linear time ?the time marked by the passing of the hours, the minutes, the seconds on a clock?the sort of time that allows us to schedule nurses, and caretakers to be with the ill, and the sort of time that allows us to schedule time to be together.? And then there is? the lived experience of time which is a more elastic experience. For example, when one is engaged in an enjoyable activity, one might feel that ?time flew by.? Alternatively, when engaged in an unpleasant activity lasting exactly as long as the enjoyable one, you might have the felt experience of linear time slowing to a crawl. When someone becomes ill and is hospitalized, it is a really common experience for the days to crawl by and for the person to lose track of linear time.

For the one dying there is a very individual circadian rhythmic time determined by the physiologic clock of the body; a primal or circular sense of time very much in tune with the lived experience rather than particular hours of the day.

These two experiences of time are woven together into the tapestry that is a part of the end of the life trajectory; the first being the somewhat circular experience of the person dying and the other being linear time of the attendants.

In many cultures, the time of one?s death is considered to be divine knowledge, attributed to, determined by, and known only to the gods. In ancient Mesopotamia, religious beliefs held that gods Anu, Ea, and Enlil determined the time of one?s death. Religions of ancient Greece believed the length of one?s lifetime to be determined by the Fates, the Moirae; Clotho, Lachesis, and Atropos. Monotheistic traditions of Judaism, Christianity, and Islam believe time was created by God? and that the time of one?s death can only be known and determined by God. It is clear that the teachings of each of many faith traditions consider death and the time of dying to be worthy of sacred consideration.? This divine, elusive, and much mythologized nature of time,? joins with mystery of death as one approaches the final threshold of this life.

Of course, the medical community also recognizes that the end of life is a time that requires uniquely tender care. Clinicians are at once called upon to compassionately engage the emotionality of the end of life process at the same time as addressing concrete medical issues that surround the dying trajectory of the individual. Just as vigiling and an attendant at the bedside are spiritually important, proper pain management and medical care at the end of life must also receive appropriate attention.

From the spiritual to the psychological, the anthropological and the medical, the fear of death has been explored, expressed, and plumbed for the wisdom that each discipline might offer to illuminate one?s life. But, somehow in all of that , the time of dying is often left unmentioned and unexplored. So, that time of life will be my focus this morning as it is the religious perspectives that inform our time of dying perhaps more than any of those I just named.

Attending to the sick is one of the few instances in Orthodox Judaism in which the obligation to the sick is more important than keeping the Sabbath.? In this tradition, it is a Talmudic dictate, a commandment given the power of Gd himself, in a culture where there is no more supreme and powerful voice than that of YHWH?that one attend the dying. Indeed, the attendant at the bedside is understood to be engaged in divine communion and prayer with God Himself by virtue of being present to the dying individual.

Followers of the Islamic faith are instructed to read the Qu?ran at the bedside of the dying. This tradition is exquisite in that it not only brings the bedside visitor into the room, but, for the follower of Islam, the practice of reading aloud gives voice to the sacred words of Allah himself. Actually, reading at the bedside at the time of dying brings to mind the Bardo Thodol, or Tibetan Book of the Dead from the Buddhist tradition.

In many traditions, the world was created by the word, the breath of the soul. Reading the holy texts at the bedside are but one way to bring the wisdom of our ancestors, through the divine breath of the human voice, into the room.

I recently had the opportunity to speak with a Jewish woman who had attended the protracted dying process of her husband. As she told her story, she spoke of her upset at having felt useless; she had not been able to do anything for him, and all she could do was sit. It was stunning to see the way that her memory of those dark days turned when I explained the sacred nature of what she had done. That according to her faith tradition, she was doing exactly what was required of her, and by so doing she herself was in the deepest form of divine communion with her Gd. Performing a sacred act that had been performed by millions of women and men before her.

Sitting at the bedside brings all of the power of ritual to bear in this sacred transition out of this life.

It is an extraordinary concept to recognize that in our busy culture the act of witnessing, being present to the sick is not only enough, but, in this unique time of life, merely being present to witness is sacred. Megory Anderson , the Executive director of the Sacred Dying Foundation in San Francisco describes the importance of ?vigiling?.Anderson writes:

Throughout history, the community of faith has traditionally been present both physically and spiritually during a death to guide the dying into the afterlife. Only recently, in the age of medicine and technology, have we passed this responsibility to hospitals and nursing homes. It is time to reclaim death and dying as a spiritual transition.

?

When we access the transcendent, a place of wonder and awe, the concerns of daily living fall away, time flows differently, and we are called to witness.? Just as birth is witnessed by those in the delivery room, so the great wisdom literature, both secular and sacred teach us that death too must be witnessed.

Is it easy to bear witness to a death? No, not at all. If it were, it wouldn?t need to be a commandment. And yet, so much of life is lived in those months, days, and moments as one approaches death, the attendant can learn a great deal at that time. A time that has frightened the wits out of many of us in its inevitability, in the sorrow and sadness of our final farewell and yet a time so sacred as to be witnessed by the Gods in cultures from the beginning of time.

Several times now I have eluded to the teachings of our common human ancestors. beginning of time, let me share with you some of the ancient literature that informs my words.

Since the earliest epic known to humankind the time of dying has been highlighted as being both sacred and unique. The epic of Gilgamesh, the first epic known to modernity, was written in approximately 2750 B.C. and exists in varying lengths and languages written over the next 1000 years! The story in it longest and most complete version, is 12 tablets long and it highlights the time of dying by both its placement in the exact center of the text, and the devotion of an entire tablet to the process.

The 1st 6 tablets tell of the exploits and adventures of the greatly mythologized King of Uruk, King Gilgamesh and Enkidu, the forest dweller and soul mate who becomes his best friend. The turning point of this story is precisely in the middle of this work. The gods having become angered by the exploits and power of this pair and decide that Enkidu must die. He becomes fatally ill and over the course of tablets 6 and 7, the reader is brought to the bedside to witness the dying process of this greatly mythologized hero.

In a dream, Enkidu witnesses the council of the gods as they determine that he will die. When he awakes, the dying man expresses his anger at those who have wronged him. After his rant, the god Shamash, a god who personifies the mystery of consciousness, appears to him. ? The God of supreme knowledge reminds Enkidu of the many blessings that were bestowed upon him during his lifetime. After this conversation Enkidu moves from furiously cursing those who have wronged him and begins to? speak his blessings of those very same individuals. He accepts that he will die and the reader is privy to the first recorded experience of the time of dying, one imagined over 4000 years ago. Throughout the time of dying, Gilgamesh sits steadfastly by his side expressing his confusion over the decision of the gods and such grief that the reader cannot help but be moved by Gilgamesh?s pain. Throughout these tablets, the two heroes speak and reflect and travel respectfully and together through this unique time of life. Ultimately it is only Enkidu who will die now. But, Gilgamesh, in all of his humanity, takes in deeply that there will be a time when he too will die. He has learned what it looks like and feels like to move through the dreaded and feared threshold that takes one from the vibrancy of life, through the sacred realm of the dying where the fluidity of time itself cannot go unnoticed. In this sacred landscape, defined by ones deepest bodily truths, the finitude of the human body is presented to the reader in all of its richness.

With the knowledge of the sacred nature of the dying process as well as the sacred nature of the attendant, it is possible to change the dynamic occurring in the room of the dying in loving and lovely ways. Anderson writes:

Each faith tradition believes that at the time of death, the soul leaves the body. Where the soul goes differs according to the religious belief, but this moment of departure is a sacred event, and one that requires not only respect from the living, but also assistance from those who witness it.

When one crosses the threshold from healthy or ill into the land of the dying, the person and his or her attendants enter the unique landscape of the time of dying, the empty time of the death watch.? It is deeply important that attendants to the dying recognize the importance of altering their own schedules to do their very best to insure that the patient not be left alone during this tender transition. Echoes of the ancient Talmudic dictum can be heard in this reverential treatment of the dying individual. But , what if no one is able to be present? Or perhaps the one who is dying asks to be left alone. How do we make sense of that when it is one we love so dearly. If that occurs, or even if it doesn?t Psyche , in union with the body,? does some very interesting things.

First, It is common that dying individuals see people such as deceased friends or relatives whom they have known during their lifetime. Others speak of visions of angels or newly beloved mates as the end of one?s own life approaches. Two wonderful examples I will share what I think is a totally darling stories on the seeing of visions?one woman told me of the last months of her Mom?s life. As her Mom moved closer to dying, she was sleeping a bit more, a fatigue often seen in those moving closer to their death. Well, this lovely woman, in her late 80?s, began to speak to her 2 daughters of her boyfriend and her cat. Her one daughter thought the old woman had gone completely nuts?because to anyone looking in, this was an elderly widow who had lived alone for years, and whose life had shrunk down to a small small room in a nursing home. Yet, in spite of her daughter?s protestations, she would describe this man, the love of her life, and when anyone came in to her room she would caution them to not let the cat out. Indeed, her dream lover, her perfect mate, had managed to move from only sleep dreaming to her waking dreams too, and she was happier than she had been in years. In Jungian terms, she was living the Heiros Gamos, the divine marriage. One daughter was desperate to treat these hallucinations. But her other daughter was thrilled to see her mother so happy and would ask her to tell of the adventures with her boyfriend, what they had for dinner, etc etc. Ultimately, the Mom died quite happy, in the arms of her perfect lover, with the cat by her side.

In some fashion, her body had created this perfect man of her dreams ..and this fortunate woman didn?t die alone at all. Can we fault the one daughter? Of course not.

Another is the woman with her ship captain. The first is a nice example of the heiros gamos that has been seen to occur in the times near death. The latter, we see the ship motif, we might recognize the figure of Charon ,the ferry boat driver of ancient mythologies. The one who ferries the souls of the dead across the river Styx.

As to seeing angels, an excellent example can be found Two thousand years after the story of Gilgamesh, as the end of the life of the great patriarch Abraham was imagined in a 1st c. piece of diasporic humor entitled The Testament of Abraham. Abraham did not leave a testament in the biblical traditions, thus leaving room for Bards of the day to create the story that they imagined to be the end of the life of this great man. The earliest versions of this story emerge in the 1st c.? AD, in the Mesopotamian basin, and the story exists in over 2 dozen written versions stemming from seven different linguistic sources, the most recent version stemming from? Romania in the 18-19th c.

Why does this particular story matter all these years later? Because as recently as 2002, over 80% of Americans self identified as being of the Abrahamic faith traditions: Judaism, Christianity, or Islam. Thus the way that the dying time of the man recognized to be the patriarch of these three great traditions has been imagined for almost 2 millenia lends insight into the ways many of the cultures which inform our own, imagined the dying time of? ?an ideal man.?

The story takes the reader to the crossroads of the Oak of Mamre, where Abraham has pitched his tent. To Abraham, the archangel Michael appears with the directive from YHWH to ?speak to Abraham about his death and to put his affairs in order.? As with Enkidu, it is imagined to be a Gd who speaks to the one who is dying to inform him or her that the dying time is near. Whether in dream as with Enkidu, or via Angelic messenger as with Abraham, the voice of Gd makes itself known in a way that the dying individual can comprehend. Angelic beings maintain the all-important link between the sacred and the profane, and so once again, the reader is reminded of the sacred nature of this time of life.

In the Testament of Abraham, Michael is instructed to gently tell Abraham that he is ?About to go out of this futile world [. . .] and depart from this body and you will go to your own Master among the good.?? Abraham welcomes the angelic messenger as a beautiful soldier, yet does not recognize the archangel for the divine figure that he is. Abraham invites the angel to be his guest in his home and to share a meal with his family. to feast together. The experience of seeing and speaking with an angel or a deceased loved one is so common now at the end of life as to merit mention on the website of the National Cancer Institute. The website gives instruction to the caregiver to not be surprised if a dying individual seems to ?hallucinate? about the presence of dead individuals in the room and the website suggests that the attendant contact a chaplain if they need to discuss it further.

All that to say that for Abraham, as with Enkidu, a message from the divine precedes the actual moment of death and we experience the grace of being given the time to make amends and to prepare ourselves for our final moments in this body on earth.

Lewis D. Solomon Ordained rabbi and professor at The George Washington University describes the dying process:

During the dying process, according to the Jewish tradition, each of us encounters beloved, deceased relatives, close friends, and wise teachers as well as angels. Prior to or at the death moment, the spirits of deceased relatives and friends, those who love us the most, visit a dying person to offer a welcome and ease the transition from the world of the living to the post death World of the Souls.

The soul, of course, is difficult to describe in words.? However the integration of the human soul with the functioning of the body is foundational to the Jewish mystical belief, the Kabbalah. Just as one?s soul lives in communion with one?s body throughout the entirety of one?s lifetime, the experience of the soul is an integral part of the dying process.

A religious conception of the human soul and angelic visitors is by no means limited to the Jewish tradition. Thirteenth-century Christian philosopher and mystic Meister Eckhart spoke of the closeness of the angels and the human soul to God Himself: Eckhart wrote:

The authorities teach that next to the first emanation, which is the Son coming out of the Father, the angels are most like God.

Eckhart describes a mystical relationship between the angels, the human soul, and ultimately God Himself. In mystical Christianity, angels are sent to the soul of an individual so that the individual may become enlightened by the knowledge of the one true God.

In the Islamic tradition, Sufi scholar Shaykh Muhammed Hisham Kabbani explains that ?The existence of angels as messengers of God is one of the pillars of belief in most religious traditions and that is the case in Islam also.?? Kabbani presents a beautifully poetic description of angels as expressed in Islamic religious lore:

God has created a tree in the seventh heaven, on each leaf of which is found one letter of the Koran. Every leaf is a throne carved from a precious stone, and every letter is represented by an angel sitting on that throne. Each angel is the key to a different endless ocean of knowledge, which has no beginning and no end. The diver into these oceans is the Archangel Gabriel.

In the Islamic tradition, The seventh heaven, is the sphere where the angels dwell, the place where the prophet Abraham dwells, and the place where God is present.

The pre-eminence of angels in the Old Testament, the New Testament, and the Qu?ran makes a compelling argument for the foundational nature of belief in angels in each of these Semitic traditions. Indeed, the emanation of an angel can be understood as an external embodied figure, such as the angel who speaks to Hagar or Muhammad; but more deeply and metaphorically, angels are recognized as a metaphors ?of ?interiority?, an ?ascent?, of ?light and darkness? and of ?oneness with God.??

While the Buddhist traditions believe in the existence of celestial beings, the belief system does not include the Abrahamic idea of Angels. That said, the Zen Hospice Project suggests that? if your loved one is experiencing hallucinations, simply be present to what is happening; it may be appropriate to just listen. Don?t try to pass judgement, or be the rational voice that angels or deceased relatives aren?t in the room?after all, how do you know??

These sorts of hallucinatory experiences tend to be pathologized as abnormal when they occur at any other time of life. But it seems that visual hallucinations are natural expressions of the body at the end of life. Whether the dis-integrating body is causative of these hallucinations is not clear. But what can be said with certitude is that these visions often occur at the end of life in individuals with no prior history of hallucinatory events. So Even now, in the 21st c, in this age of hyper rationalism, it is the language of the sacred provides the vocabulary to voice the mysterious experiences that shroud the time of dying.

It is hard to bear witness to a death. If it were easy, there would have been no reason for our human ancestors to have given the power of the voice of God to a commandment to do so. Perhaps our ancestors knew that witnessing and ministering to the sick and dying was so primal, so important for the survival of society, that the commandment was understood to be given from YHWH himself.

Bearing witness to the end of a life did then and does now call us to be deeply human, to be open to the mystery of this magical time of life? to have the courage to listen to the teachings of our ancestors and recognize that the time of dying as a time that is sacred and unique.? The wisdom literature handed down to us from millions of people over thousands of years teaches that witnessing is a moral imperative.
